If you have not received all of the above materials, please contact CSD Compliance Officer – Ian Taylor immediately on 0427 921 480.
| Step 1: |
Appoint Compliance Officer Please appoint a Compliance Officer to oversee the completion of the 2026 Competition Law Training. Ideally, the Compliance Officer should be a senior executive of the Agent who is not involved in carrying out the Agent’s obligations under the Planting Seed Agency and Service Agreement (Agency Agreement) with CSD. The Compliance Officer must be a person with appropriate authority to oversee the 2026 Competition Law Training and sign the 2026/2027 Certificate of Completion of Competition Law Training. |
| Step 2: |
Identify Relevant Persons Once appointed, the Compliance Officer must identify directors, officers, employees and representatives of the Agent who in carrying out the Agent’s obligations under the Agency Agreement with CSD, could be concerned with conduct that may contravene Part IV of the Competition and Consumer Act 2010 (Cth) (the Relevant Persons). If the Compliance Officer is in any doubt as to whether any director, officer, employee or representative of the Agent will or may be a Relevant Person, the Compliance Officer should err on the side of caution and treat that person as a Relevant Person. |
| Step 3: |
View 2026/2027 Competition Law Training Recording Once the Compliance Officer has identified all of the Relevant Persons, the Compliance Officer must ensure that each Relevant Person watches the 40 minute 2026/2027 Competition Law Training Recording in its entirety. |
| Step 4: |
Complete 2026/2027 Competition Law Training Test Once a Relevant Person has watched the 2026/2027 Competition Law Training Recording, the Compliance Officer must require that person to complete the 2026 Competition Law Training Test. The Compliance Officer should ensure appropriate arrangements are made to prevent copying or cheating by Relevant Persons. |
| Step 5: |
Marking 2026/2027 Competition Law Training Tests Once the 2026/2027 Competition Law Training Test has been completed by a Relevant Person, the tests will be marked automatically. To pass the 2026/2027 Competition Law Training Test, the Relevant Person must achieve a minimum score of 8 out of 9. CSD will advise the Compliance Officer whether or not each Relevant Person has achieved the minimum score or higher and if they have not, which answers were incorrect. If a Relevant Person does not achieve the minimum score, the Compliance Officer must require the Relevant Person to watch the 2026 Competition Law Training Recording and complete the answers that were incorrect previously until the Compliance Officer is notified by CSD that they have achieved at least the minimum score. |
| Step 6: |
Return completed 2026/2027 Certificate of Competition Law Training Once all Relevant Persons have viewed the 2026 Competition Law Training Recording and passed the 2026 Competition Law Training Test, CSD will generate a Certificate of Completion of Competition Law Training and the Compliance Officer must:
|
| Step 7: |
New employees If any new directors, officers, employees or representatives of the Agent commence after the date the 2026/2027 Certificate of Completion of Competition Law Training has been signed who deal with CSD Seed or carry out the Agent’s obligations under the Agency Agreement (New Relevant Persons), the Compliance Officer must ensure that the New Relevant Person completes and passes the 2026 Competition Law Training in accordance with Steps 3-5 before they commence any work for CSD. |
